End-User License Agreement

1. Acceptance of Terms

These are the terms of use for “Stickey’s Garage”, "we," "us," or "our". By accessing and using Stickey’s Garage's mobile application or website (collectively referred to as the "Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use the Service.

2. Description of Service

Stickey’s Garage makes keeping track of the maintenance of your vehicles and other assets easy.

3. User Responsibilities

(a) Eligibility: By using the Service, you represent and warrant that you are of legal age to enter into a binding agreement.

(b) Account Creation: You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account information and agree to be solely responsible for all activities that occur under your account.

(c) Acceptable Use: You agree to use the Service in compliance with applicable laws and regulations. You will not use the Service for any unlawful purpose or engage in any activity that could harm the Service or its users.

(d) User Content: You are solely responsible for any content you post or submit through the Service. By submitting content, you grant Stickey’s Garage a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with the Service.

4. Intellectual Property

(a) Ownership: Stickey’s Garage retains all rights, title, and interest in and to the Service, including any content, logos, trademarks, and other intellectual property.

(b) License: Subject to your compliance with these Terms of Use, Stickey’s Garage grants you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

5. Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and disclose information.

6. Termination

Stickey’s Garage reserves the right to terminate or suspend your access to the Service at any time without prior notice for any reason, including if you violate these Terms of Use.

7. Limitation of Liability

Stickey’s Garage shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service.

8. Indemnification

You agree to indemnify and hold harmless Stickey’s Garage and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of or related to your use of the Service or violation of these Terms of Use.

9. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Arizona. Any legal action or proceeding arising out of or related to these terms shall be brought exclusively in the courts of the State of Arizona.

10. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms of Use shall be resolved by mediation. If mediation is unsuccessful, the dispute shall be finally settled by arbitration in the State of Arizona, conducted in English. The award rendered shall be binding and enforceable in any court of competent jurisdiction.

. 11. Purchases and Subscriptions

Generally
From time to time, Stickey’s Garage may offer products and services for purchase, including auto-renewing subscriptions (“In-App Purchases”), through the Apple App Store, Google Play Store, carrier billing, Stickey’s Garage direct billing, or other payment platforms authorized by Stickey’s Garage.
If you choose to make a purchase, you will be prompted to confirm your transaction with the applicable payment provider. Your selected payment method (such as a credit/debit card, Apple ID, or Google Play account) (“Payment Method”) will be charged the price displayed at the time of purchase, along with any applicable taxes. By confirming the purchase, you authorize Stickey’s Garage or the relevant third-party payment provider to charge your Payment Method.

Auto-Renewal Subscriptions
If you purchase an auto-renewing subscription, your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.

• Your Payment Method will be charged at the beginning of each subscription period.
• The subscription will renew for the same duration and at the same price unless otherwise disclosed at the time of purchase.
• You must manage or cancel your subscription through your Apple App Store account, Google Play account, or Stickey’s Garage account settings (as applicable).

Deleting your Stickey’s Garage account or uninstalling the application does not cancel your subscription. You remain responsible for all charges until you properly cancel the subscription through the applicable platform. If you cancel, you will continue to have access to your subscription benefits until the end of the current billing period. No partial refunds will be issued for unused time unless required by law.

Direct Payments to Stickey’s Garage
If you purchase a subscription or service directly through Stickey’s Garage:

• Stickey’s Garage reserves the right to correct billing errors even if payment has already been processed.
• If a chargeback or payment reversal is initiated, Stickey’s Garage may suspend or terminate your account at its sole discretion.
• If payment fails due to expiration, insufficient funds, or other reasons, you authorize Stickey’s Garage to retry charging your Payment Method or any updated payment information provided by your financial institution.

You are responsible for keeping your Payment Method information up to date.

Refunds
All purchases are generally non-refundable, and no refunds or credits will be provided for partially used subscription periods unless required by applicable law. If a refund is available under local law or platform policy:

• Apple App Store purchases: Refunds are handled exclusively by Apple. Please request a refund through your Apple ID purchase history or via Apple Support.
• Google Play Store purchases: Refund requests must be submitted through Google Play.
• Direct purchases through Stickey’s Garage: Contact customer support with your order number and registered account details.

Statutory Cancellation Rights (U.S. Residents)
For residents of states where consumer protection laws apply (including but not limited to California, New York, and Illinois):

• You may cancel your subscription within the legally permitted cancellation period without penalty.
• In the event of death or permanent disability preventing use of the service, a prorated refund may be issued upon valid request and documentation, as required by law.

Pricing and Promotions
Stickey’s Garage operates globally, and pricing may vary based on region, subscription duration, features, or promotional offers. Prices are subject to change, and any changes will be communicated in advance where required by law.
Promotional pricing applies only for the disclosed period and will revert to standard pricing thereafter unless canceled.

12. User Conduct

You agree to use the Service in compliance with all applicable laws and regulations and not to engage in prohibited activities including harassment, unlawful content, malware distribution, impersonation, or spamming.

13. Disclaimer of Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. STICKEY’S GARAGE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Third-Party Links

The Service may contain links to third-party websites not controlled by Stickey’s Garage. We are not responsible for the content, policies, or practices of any third-party services.

15. Changes to the Service

Stickey’s Garage reserves the right to modify, suspend, or discontinue the Service at any time without notice and without liability.

16. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Updates to this Terms of Use

We may update these Terms of Use from time to time. Any changes will be posted with an updated effective date.
